Ontario Court of Justice / Superior Court of Justice
Family law involves both federal and provincial legislation. As a result, jurisdiction over family cases in Ontario is divided between the Ontario Court of Justice and the Superior Court of Justice. Both courts preside over family law cases involving parenting time, decision making authority (formerly called “custody and access”), as well as child support and spousal support issues.
Child protection and adoption cases must be heard in the Ontario Court of Justice. Family law cases seeking an Order for Divorce or involving property issues must be heard in the Superior Court of Justice.
Miscellaneous
When filing for Divorce, you are required to file your original Marriage Certificate. If you do not have yours, you can apply for it using this link.
